  77. <p>The White House approved and released the Department of Education’s sweeping <a href="https://www.insidehighered.com/news/government/2024/04/19/biden-administration-finalizes-title-ix-overhaul">changes</a> to <a rel="noreferrer noopener" href="https://www2.ed.gov/about/offices/list/ocr/docs/tix_dis.html" target="_blank">Title IX’s</a> implementing regulations last month, changing the rules for how colleges conduct investigations into allegations of sexual harassment and assault. Colleges now have until August 1 to comply. Though the 1,561 pages making up the <a rel="noreferrer noopener" href="https://www2.ed.gov/about/offices/list/ocr/docs/t9-unofficial-final-rule-2024.pdf" target="_blank">notice of final rulemaking</a> have generated controversy on many fronts, there are three significant changes warranting particular attention.</p>
  78. <p>Specifically, the regulations now give institutions the <em>option</em> of:</p>
  79. <ol type="1">
  80. <li><strong>Adopting the Single-Investigator Model.</strong> The campus Title IX coordinator/investigator (the <em>de facto</em> campus prosecutor) may now in the same matter serve as the ultimate fact finder <em>and</em> decision-maker (the <em>de facto</em> campus judge and jury).</li>
  81. <li><strong>Dispensing With Live Hearings, Cross-Examination, and Expert Testimony.</strong> The accused no longer has a right to a trial-like, live hearing with cross-examination, and the parties have no right to introduce expert witness testimony.</li>
  82. <li><strong>Lowering the Standard of Proof.</strong> The revised regulations create a default presumption that adjudications of responsibility will now be based on a <a rel="noreferrer noopener" href="https://www.law.cornell.edu/wex/clear_and_convincing_evidence" target="_blank">lower</a> standard of proof, namely, preponderance of the evidence (“more likely than not”—or “50 percent plus a feather”), rather than the more demanding standard of clear and convincing evidence (“highly probable”). The 2020 regulations allowed colleges to choose between the two standards, while the new regulations create the default expectation that the lower standard be used unless the higher standard is used in all comparable proceedings.</li>

  93. <h2>A Short Title IX Primer</h2>
  94. <p><a rel="noreferrer noopener" href="https://www.govinfo.gov/content/pkg/USCODE-2021-title20/pdf/USCODE-2021-title20-chap38-sec1681.pdf" target="_blank">Title IX</a> of the Education Amendments of 1972 is a landmark <a rel="noreferrer noopener" href="https://www.justice.gov/crt/title-ix" target="_blank">civil rights law</a> prohibiting discrimination based on sex in all education programs and activities receiving federal dollars through student loans, grants and otherwise. Covered institutions include almost all colleges and universities, which must respond promptly and effectively to claims of sex discrimination lest the federal funding on which they heavily depend be shut off. Although colleges are, of course, free in their codes of conduct to adopt more vigorous processes than those permitted under the new regulations, Title IX sets the procedural floor.</p>
  95. <p>Most of the just-released revisions are morally and legally understandable and <a rel="noreferrer noopener" href="https://www.nationalreview.com/2024/04/the-department-of-education-dilutes-campus-due-process/?bypass_key=cTlIdFhmWnJtV1NVU01valdzdWRmdz09OjpkRTR4TTJWMmVteGFWRGt3ZFhSUmJYaHFiRkZIWnowOQ%3D%3D" target="_blank">justifiable</a>. In a few specific areas, however, they threaten to tip the balance too far in favor of administrators and against the accused, to whom the regulations accord a presumption of innocence (or “non-responsibility”). In so doing, they raise genuine questions not only over procedural fairness and the factual accuracy of campus “guilt” determinations, but also over the legitimacy of the potentially lifelong negative impacts that frequently ensue.</p>
  96. <h2>What Is at Stake?</h2>
  97. <p>As anyone who has worked in the Title IX arena knows, college disciplinary proceedings (“grievance procedures,” in Title IX parlance) involving allegations of sex discrimination are weighty matters. Students or staff found to have violated an institution’s code of conduct (“respondents”) can be expelled, have their diplomas revoked, and otherwise be exposed to potentially life-altering impacts. Being dismissed from a college and getting prosecuted for a crime are, of course, not the same. Yet both can occur based on the same incident and carry similar collateral consequences.</p>
  98. <h2>Reasons to Be Skeptical of the Single-Investigator Model</h2>
  99. <p>In allowing institutions to use a single-investigator model once again, the Education Department contends that “requiring separate staff members to handle investigation and adjudication is burdensome for some recipients.” The burden is undoubtedly real. But considering how vital a neutral and fair final decision-maker is to the fairness of the process, the accuracy of the fact-finding, and the integrity and robustness of the final decision, any additional administrative inconvenience and cost are more than justified (and are likely to save money and headaches down the road).</p>
  100. <p>More to the point, adopting the single-investigator model will inevitably invite serious substantive constitutional challenges, in particular for state-run colleges. Consider, for example, the U.S. Court of Appeals for the Sixth Circuit’s 2018 ruling in <a rel="noreferrer noopener" href="https://www.opn.ca6.uscourts.gov/opinions.pdf/18a0200p-06.pdf" target="_blank">Doe v. Baum, et al.</a> The court ruled that “if a public university has to choose between competing narratives to resolve a case, the university must give the accused student or his agent [1] an opportunity to cross-examine the accuser and adverse witnesses [2] in the presence of a neutral fact-finder.”</p>
  101. <p>The Education Department, perhaps sensing the weakness of its position based on administrative ease, notes that colleges can of course voluntarily <em>elect</em> to use independent fact finders. Colleges concerned with the accuracy and fairness of these important processes and not wishing to become magnets for litigation should be wary of adopting the single-investigator model.</p>
  102. <h2>Reasons to Be Skeptical of Scrapping Live Hearings</h2>
  103. <p>The Education Department contends that requiring cross-examination may re-traumatize complainants, dissuade reporting of misconduct, and inject an unnecessary adversarial dynamic into the system. These concerns are undoubtedly serious and genuinely held.</p>
  104. <p>However, the values of fairness and rigor will, in the longer term, significantly outweigh the perceived short-term gains promised by eliminating the right to a live hearing. As the Baum decision highlighted, the “opportunity to cross-examine the accuser and adverse witnesses” is a central component of a fair process during which competing narratives must be resolved. Colleges that opt to make this historically significant right a thing of the past will almost certainly face significant legal challenges alleging procedural unfairness and unfair outcomes.</p>
  105. <p>Turning to the right to present expert testimony, although the revised regulations, as with the single-investigator model and the right to a live hearing, give colleges the <em>discretion</em> to allow the parties to present expert witnesses, they are no longer <em>required</em> to do so.</p>
  106. <p>According to the Education Department, “the use of expert witnesses may introduce delays without adding a meaningful benefit to the recipient’s investigation and resolution of the case.” Decision-makers will have to render many challenging judgments; ruling on the relevance of potentially important and illuminating expert testimony will, from a big-picture perspective, be a relatively light lift.</p>
  107. <h2>Reasons to Be Skeptical About Lowering the Standard of Proof</h2>
  108. <p>Many colleges and universities will be tempted to accept the Education Department’s default option to rely on the preponderance of the evidence standard (“more likely than not”—or “50 percent plus a feather”), as opposed to the clear and convincing evidence standard (“highly probable&#8221;). These institutions should remain mindful, however, that using a higher standard of proof will help ensure that their final decisions are, and appropriately will be viewed as, more robust and defensible. The accused, their accusers and the system as a whole should welcome a standard of proof that lends extra integrity to the final factual finding.</p>
  109. <h2>Litigation on the Horizon</h2>
  110. <p>Though the outcome of any litigation challenging the revised regulations on constitutional grounds is likely far in the future, and most of the anticipated litigation will be filed by students who have yet to be disciplined, observers should pay particular attention to <a rel="noreferrer noopener" href="https://www.law360.com/cases/6630214b0006effb15a370b6" target="_blank" data-type="URL">State of Alabama v. Cardona</a>, filed April 29 in the U.S. District Court for the Northern District of Alabama. In that case, a group of plaintiffs, including the states of Alabama, Florida, Georgia and South Carolina, argue that the revised regulations violate the Administrative Procedure Act (APA). According to plaintiffs:</p>
  111. <blockquote class="wp-block-quote">
  112. <p>The elimination of a parties’ right to a live hearing with cross-examination, even when credibility is a key issue, is arbitrary and capricious. The challenged rule states that college students accused of misconduct—charges that could ruin their academic and professional careers if they are found guilty—no longer have a right to be accompanied by counsel at all proceedings … The Department has not reasonably considered these concerns …</p>

  114. <p>The complaint goes on to argue that the revised regulations fail to “adequately consider the significant due-process concerns of a single-investigator model, let alone how its interests militate the grave dangers of allowing a single person [to] investigate, prosecute, and convict.” More broadly, the plaintiffs argue that “[t]he rule’s changes separately and collectively raise grave concerns, opening recipients up to lawsuits raising due-process claims.”</p>
  115. <p>The <a href="https://www.law.cornell.edu/uscode/text/5/706" target="_blank" rel="noreferrer noopener">APA</a> requires courts to “hold unlawful and set aside agency action” that is “arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law”; “contrary to constitutional right, power, privilege, or immunity”; or “in excess of statutory jurisdiction, authority, or limitations, or short of statutory right.” That said, reviewing courts are not permitted to substitute their own judgment for that of the agency.</p>
  116. <p>Although the policy arguments raised here overlap with many of those that plaintiffs raise in the Cardona case, the Education Department, with its over 1,500-page notice of final rule-making, has gone out of its way to inoculate its decision-making against arbitrary and capricious challenges. Though the revised regulations’ policy deficiencies in the area of disciplinary proceedings are many, overcoming the APA’s intentionally high bar will be a challenge.</p>
  117. <h2>Administrative Options and the Future of the Revised Regulations</h2>
  118. <p>Experience teaches that swapping due process and impartiality in decision-making for administrative efficiency, wherever this occurs, more often than not is a bad trade-off for all parties involved. This is especially true where serious consequences, like those present in Title IX grievance procedures, flow from the decisions reached. The revised regulations allow colleges and universities to take the administratively easy way out. Yet the noteworthy changes discussed here stand out because they generate serious litigation risk and avoidably put the institution’s commitment to the truth-seeking process in question.</p>
  119. <p>College disciplinary proceedings resulting in potentially severe sanctions should never be, or be perceived as, a less than reliable rubber stamp. The stakes are far too high for both the accused (who deserve reliable fact-finding) and the victims (who deserve robust, defensible determinations of the factual guilt of their victimizers). Even campus administrators who champion the new regulations should think carefully about the long-term potential for unfair results, ramped-up litigation and stakeholder skepticism before succumbing to the siren song of short-term administrative efficiency.</p>

  210. <p>Discussing her ordeal, Harrison added: &#8220;I feel like one of the biggest challenges in general is these big social media companies who are hosting pornographic images and videos, they don&#8217;t have any way of us getting through to them to report it when there is something unconsented there.</p>
  211. <p>&#8220;It shouldn&#8217;t be robots that you get through to when it&#8217;s this important a situation, it shouldn&#8217;t be that hard to get through to someone.</p>
  212. <p>&#8220;I&#8217;m not saying delete it, I&#8217;m not saying take this person&#8217;s account down, I&#8217;m just saying can we pause it and then review it in a few weeks and I think that is the biggest issue we are dealing with at the moment.&#8221;</p>
  213. <p>Harrison added: &#8220;But I think if something gets to the level where you say this is me in a sexually explicit act and I have not given permission, it should be paused that day, not in four to six days.&#8221;</p>

  215. <p>On discovering the video was online, she said: &#8220;For the first few days, I was really just going through waves of complete sorrow and shock.</p>
  216. <p>&#8220;It got to the point where I was so emotionally affected by what happened to me that I ended up being physically ill as well to the point where I was in hospital for five days over Christmas a little bit after the incident because the stress took such an effect on my body.</p>

  251. Of course, most classic albums from the Sixties through the Eighties stuck to those lengths because of the limitations of the LP format. To this day, record executives cite Michael Jackson’s <em>Thriller</em> and Marvin Gaye’s <em>What’s Going on</em> (nine songs each) as examples of perfect records that didn’t overstay their welcomes. Those restrictions flew out the studio window when the compact disc arrived in the Eighties. With running times that could extend to 80 minutes — twice the length of a typical vinyl album — the CD allowed artists to jam as many songs as they wanted onto a new album. If said artists wrote or co-wrote their own material, it could also result in a windfall of publishing income, which only encouraged self-indulgence. And in the streaming era, the more songs there are for fans to stream, the better an artist’s chart placement and revenue.</p>

Retaining listeners’ attention — with so many other distractions vying for time — may also be playing into the trend, according to one senior major-label A&amp;R executive. “For this generation, the album experience is much different,” the executive says. “In the past you’d put on <em>Dark Side of the Moon</em>, turn off the lights and listen. It was an immersive experience. Now albums are just one part of their menu.”</p>

Kentish agrees that more succinct albums are a way of combatting the behavior of some music listeners to bounce around streaming services, from one artist or album to another. “When you put music on a streaming service, there’s a lower chance they’ll be listening to it in that order,” he says. “In that environment, it makes people want shorter records. You’re trying to keep people’s attention. You own the environment of what someone is listening to, to some extent.”</p>

The other label executive thinks that the ease with which new music can be recorded and released is also a factor: Dua Lipa and Rodrigo, for instance, rolled out expanded editions of <em>Future Nostalgia</em> and <em>Guts</em>, respectively, with additional songs. “Everyone is recording a lot of music, and they’re not calling a 10-song album ‘chapter 1,’ but it probably is,” says the executive. “You think it’s the whole meal but there’s another entrée after that. I don’t know if that’s cynical, but it’s the reality.”</p>

As of Tuesday, they were still available for purchase on Panera&#8217;s website. </p>
  322. <p>The move comes as Panera revamps its menu to offer new &#8220;low-caffeine&#8221; drink options amid <span class="link"><a href="https://www.cbsnews.com/news/panera-lawsuit-charged-lemonade-caffeine-death/" target="_blank" data-invalid-url-rewritten-http="" rel="noopener">allegations that the caffeinated lemonade drinks caused two deaths</a></span>. Another plaintiff alleges Panera&#8217;s Charged Lemonade <span class="link"><a href="https://www.cbsnews.com/news/panera-bread-lawsuit-charged-lemonade-caffeine-lauren-skerritt/" target="_blank" data-invalid-url-rewritten-http="" rel="noopener">left her with long-term heart problems</a></span>. Panera did not indicate why it&#8217;s phasing out Charged Sips. The company did not comment on pending litigation. </p>

  327. <p>&#8220;We listened to more than 30,000 guests about what they wanted from Panera, and are focusing next on the broad array of beverages we know our guests desire — ranging from exciting, on-trend flavors, to low-sugar and low-caffeine options,&#8221; Panera said of its recent menu changes. The company&#8217;s new beverage offerings include a &#8220;Blueberry Lavender Lemonade&#8221; among other options. </p>
  328. <p>Sarah Katz, a 21-year-old college student with a heart condition, died in September 2022 after drinking a Charged Lemonade beverage. Her family <span class="link"><a href="https://www.cbsnews.com/news/panera-charged-lemonade-caffeine-sarah-katz-death-lawsuit/" target="_blank" data-invalid-url-rewritten-http="" rel="noopener">filed a lawsuit against Panera</a></span> alleging the lemonade drink, which contains higher caffeine levels than Red Bull and Monster Energy Drink combined, came with no warning. </p>
  329. <p>A second lawsuit alleges that Dennis Brown of Fleming Island, Florida, died from cardiac arrest after downing three of the drinks and unknowingly <span class="link"><a href="https://www.cbsnews.com/news/how-much-caffeine-health-effects/" data-invalid-url-rewritten-http="">consuming high levels of caffeine</a></span>, according to the suit filed in Superior Court in Delaware. </p>
  330. <p>On its <a href="https://www.panerabread.com/en-us/menu/categories/beverages.html" target="_blank" rel="nofollow noopener">website</a>, the Charged Sips beverages contain between 155 and 302 milligrams of Caffeine. They come with a warning indicating they are not recommended for &#8220;children, people sensitive to caffeine, pregnant or nursing women.&#8221;</p>
  331. <p>It&#8217;s safe for most healthy adults to consume up to 400 milligrams of caffeine a day, <a href="https://www.mayoclinic.org/" target="_blank" rel="nofollow noopener">according to The Mayo Clinic</a>. That&#8217;s the rough equivalent of about four cups of coffee or 10 cans of soda.</p>

  367. <p>A major UK shopping centre has been evacuated after a &#8220;security threat&#8221; this morning. Shoppers have reported being told to get out of Westfield shopping centre in Stratford, east London. People attempting to enter the Westfield were turned away by emergency services attending the scene.</p>
  368. <p>The reason for the lockdown is a &#8220;security threat&#8221;, according to several witnesses, as a number of police cars have been spotted outside. </p>
  369. <p>Following an inspection, the Met Police confirmed the item was not suspicious and have allowed shoppers back into the centre.</p>
  370. <p>In a statement, they said: &#8220;At 10:15hrs on Wednesday, 8 May, police were alerted to a possible suspicious item at Stratford Place, E20.</p>
  371. <p>&#8220;The surrounding area was evacuated as a precaution while the item is assessed. The item was found to be non-suspicious and the incident was stood down at 11:25hrs.&#8221;</p>

  439. <p class="">Instead, many linked arms and formed a human chain in direct defiance of campus police officers who had dismantled the protest area hours earlier.</p>
  440. <p class="">Graduate student Christopher Iacovetti said he was asleep in a tent around 4:30 a.m. when university police first descended on the pro-Palestinian encampment.</p>
  441. <p class="">“They stormed in aggressively — screaming us down, chasing us around, ramming us with shields and so forth,” he said. “It was hideous, it was ugly, and it was, above all, cowardly.” </p>
  442. <p class="">Administrators initially tolerated the protest when it started early last week, but that had changed by Friday, when President Paul Alivisatos warned in a letter to the university community that demonstrators had violated policies and that the encampment “cannot continue.” </p>
  443. <p class="">After it was torn apart, Alivisatos said in a statement that he had given students plenty of warning to avoid escalation.</p>
  444. <p class="">“Protest is a strongly protected form of speech in the UChicago culture, and the demonstrators had multiple opportunities to express their views,” he said. “But many aspects of the protests also interfered with the free expression, learning, and work of others. Safety concerns have mounted over the last few days, and the risks were increasing too rapidly for the status quo to hold.”</p>

  446. <p class="">Eman Abdelhadi, an assistant professor of comparative human development, said Tuesday’s actions by the university were disappointing and shocking after its initial openness.</p>
  447. <p class="">“I think it’s really a sad end to a space that has felt like a community space and healing and grieving space for the entire neighborhood,” she said, adding the antiwar movement will not be dissuaded. </p>
  448. <p class="">“Our students are incredibly brave and smart and sophisticated,” she said. “I’m proud of them every day for the work that they’re doing.”</p>
  449. <p class="">The about-face in Chicago reflects a broader frustration experienced by both students and administrators across the country. </p>
  450. <p class="">Nearly three weeks into a movement launched by a protest at Columbia University in New York City, the Rhode Island School of Design held talks with protesters occupying a building, and the Massachusetts Institute of Technology dealt with a new encampment on a site that was cleared but immediately retaken by demonstrators.</p>
  451. <p class="">MIT officials said Tuesday that &#8220;dozens of interim suspensions and referrals to the Committee on Discipline are now in process.&#8221;</p>
  452. <p class="">Bill Townsend, CEO of College Rover, a university comparison tool for prospective students and their parents, said universities are embarking on &#8220;the slippery road to self-censorship and society’s unwillingness to be uncomfortable.”</p>
  453. <p class="">“Colleges want to be at the forefront of controversial subjects but do not seem capable of handling the pressure put back on them,” he said. “Now, of course, safety is paramount — but this seems uncalled-for.”</p>

  455. <p class="">Since April 17, when largely peaceful protest encampments first appeared at Columbia University, administrators have struggled to balance free speech with securing campuses and protecting students, the majority of whom are not participating in the protests.</p>
  456. <p class="">The University of California, Berkeley, which became the first campus in California to join the encampment movement last month, has remained largely peaceful. No stranger to protests, the Bay Area university has focused on creating an open dialogue between administrators and pro-Israel and pro-Palestinian students, university spokesman Dan Mogulof said.</p>
  457. <p class="">&#8220;We’ve been down this road before,&#8221; he said. &#8220;We&#8217;ve drawn from our own experience and the experience of others that the utilization of law enforcement, while sometimes necessary, can have unintended consequences.&#8221;</p>
  458. <p class="">In a similar vein, the president of Wesleyan University in Connecticut wrote an opinion piece this week explaining why the encampment there will be allowed to stay. </p>
  459. <p class="">“This is a protest directed at the administration, and I don’t get to choose the protesters’ messages,” President Michael S. Roth, who opposes the war in Gaza, wrote in <a href="https://newrepublic.com/article/181341/wesleyan-president-not-calling-police-student-gaza-encampment" target="_blank" rel="noopener">The New Republic</a>. “I do want to pay attention to them.”</p>
  460. <p class="">At the University of North Carolina, Chapel Hill, antiwar student protesters called on faculty and teaching assistants Monday to withhold reporting official grades until the school gave amnesty to students who had been suspended for protesting.</p>
  461. <p class="">The university rejected the demand and said any instructor who withheld grades would be subject to sanctions.</p>
  462. <p class="">“We strongly support the right of faculty and graduate students to express their opinions freely but there are better ways to do this than hurting our students and abrogating our contract with the people of North Carolina who support our university,&#8221; officials said in a statement.</p>

  464. <p class="">On Monday, Columbia became the latest institution of higher learning to have rethought graduation plans following weeks of increasingly chaotic protests that culminated with the arrests of at least 80 students.</p>
  465. <p class="">Administrators <a href="https://www.nbcnews.com/news/us-news/columbia-university-cancels-commencement-rcna150778" target="_blank" rel="noopener">canceled the universitywide ceremony</a> in favor of smaller, independent ceremonies for associated colleges. The decision was made after discussions with student leaders amid security concerns, the university said in a statement.</p>
  466. <p class="">New York Mayor Eric Adams this week praised area universities for how they handled the protests, saying many were caught off-guard by the campus unrest.</p>
  467. <p class="">“Columbia and all of these presidents were hit out of nowhere with something that no one could have thought about,&#8221; he told reporters. &#8220;And I really take my hat off to them. It was a very difficult time.&#8221;</p>
  468. <p class="">Last month, the University of Southern California in Los Angeles <a href="https://www.nbcnews.com/news/us-news/usc-cancels-commencement-columbia-students-worry-disrupted-rcna149205" target="_blank" rel="noopener">canceled its main commencement ceremony</a>, which would have included a keynote address from alumnus Jon M. Chu, director of “Crazy Rich Asians,” a presentation of honorary degrees to tennis star Billie Jean King, and high-profile speakers. </p>
  469. <p class="">The decision was made shortly after USC said its valedictorian, a South Asian American Muslim woman, would not be allowed to deliver the customary commencement speech because of threats to her and the university. School officials never said what the threats were or who made them.</p>
  470. <p class="endmark">At UCLA, violent clashes between protesters and counterprotesters led school officials to call in officers and deputies, resulting in dozens of arrests and an independent investigation into why administrators were slow to seek help from law enforcement.</p>
