This year can’t be any worse than the last two, so I am excited
and optimistic. For one thing I don’t have to worry about buying and selling
homes, moving and selling my coach. I’m completely settled in and can devote
all my time to normal life and business.

I have some exciting business plans and hope they happen in
the first quarter of the year. I’m confident they will be of a benefit to my Entertainment,
Group Health and Professional Small Business programs.

SKYPE vs ZOOM

I want to address my thoughts on video conferencing: there
is no question that Zoom has become the leader in this sphere, but I’ve been reluctant
to install and use. I’m just not comfortable with a service where 95% of support
comes from China – even if it is owned by a U.S. citizen. For this reason, I’ve
chosen to continue with Skype where everything is U.S. based. I can receive video
calls from a Zoom caller without installing the program, so I have the bases
covered while remaining in my comfort level.

I see no way that can happen. First, I’m not willing to travel until the virus

is opened up, and then there’s the coach: It is already past the service date
and the closest place to have it done (Rush Truck Center) is 35 to 40 miles
away. Again, until this is well and truly under control, I’m not even willing
to take an Uber ride for a quarter of a mile, much less 35 or 40! Nor am I

HCSMs operate either by matching paying members with those who need funds for medical expenses or “sharing” health costs on a voluntary basis. HCSMs may present coverage in ways that look and feel similar to health insurance, but claim to offer an “alternative” to health insurance. HCSMs often cost less than health insurance. However, before you sign consumers up for an HCSM, there are some things you should know:

• HCSMs don’t guarantee payment of claims. That means that while they may share funds with members who have health needs, they are not legally required to do so.

• HCSMs usually cap what they will pay. This means that even if an HCSM will cover your treatment, the HCSM may stop paying once the treatment costs exceed a certain dollar amount, leaving you with the bill.

• Most HCSMs claim they are not insurance and are therefore exempt from state law. This is untrue. To the extent HCSMs are transacting insurance they fall under the jurisdiction of the Department of Insurance and must have a valid license in order to do business in California. Whether a particular medical service will be covered is completely up to the Sharing Ministry and what is covered can change at any time without prior notice. Most HCSMs do not comply with the consumer protections of the federal Affordable Care Act (ACA), like covering treatments for pre-existing conditions or capping out-of-pocket costs. If care or treatment is not covered, insureds cannot appeal for an independent medical review overseen by the State of California

• HCSMs usually don't have provider networks, so members may be charged full price by doctors and hospitals, rather than the lower negotiated rates charged to consumers who have insurance coverage.

• HCSMs may provide value to some, but they pose a risk to others because they often provide limited benefits.

• Under certain circumstances membership in a health care sharing ministry exempts members from the state individual health insurance mandate, but only if the ministry meets a specific a definition found in the Affordable Care Act (ACA). Many HCSMs do NOT meet this definition and therefore membership does not exempt individuals from the state or federal mandate.

PROFESSIONAL SMALL BUSINESS PACKAGE

We now offer packages for 120 professions and 4 lines of business.

Below are explanations of each:

HSA

A Health Savings Account (HSA) is a tax-deductible savings account that is owned and funded by the employee to help save for - and cover - qualified health care expenses and prescriptions. Like a bank account, HSA funds remain with the member, but can only be spent on health care expenses. Insurance Companies can pair an HSA with a High Deductible Health Plan (HDHP) or Consumer Driven Health Plan (CDHP(1) ) to help cover out-of-pocket medical expenses, including prescription drugs. Like the HRA, employers can add funds to an HSA as a rewards program for employees who engage in healthy lifestyle choices.

HRA

A Health Reimbursment Account (HRA) is an employer-funded health savings account. Insuarance Companies can pair an HRA with a High Deductible Health Plan (HDHP) or a Consumer-Driven Health Plan (CDHP) to help employees pay for covered costs. CDHPs often require employees to pay the deductible first, before the HRA account will reimburse additional health care costs. Employers can also add funds to the HRA to establish a rewards program for employees who engage in healthy lifestyle choices.

FSA

A Flexible Spending Account (FSA) is an arrangement that employees set up with their employers, allowing them to set aside pre-tax money to pay various kinds of expenses, like co-insurance or child care, for example. An FSA can be paired with any plan. Insurance Companies can set up an FSA that is directly integrated with medical claims processing, so employees are automatically reimbursed for eligible out-of-pocket expenses.

CDHP (1)

Typically, CDHPs have lower premiums but higher deductibles (the amount members pay out-of-pocket for health services before the health plan pays). CDHPs are typically paired with Health Savings Accounts (HSA). An HSA is a tax-exempt bank account, set up to help save for - and cover - qualified health care expenses and prescriptions. A CDHP combined with an HSA or other type of health account may also be called a high deductible health plan (HDHP).
insured – against another’s property – for example an auto accident. So can you
assume the same will hold true if you hit one of your Hired Autos with another?
No, not unless you have Hired/Non-Owned Auto Physical Damage coverage. Most
assume that because both vehicles are property of others it should be, but once
those vehicles are in your care, custody, and control it is no longer
considered someone else’s property.

If you drive your hired
auto into a building on the main street (that has no relation to the shoot),
damage to that building is covered under your HNOA policy. But what if you
accidently drive it into the location you are filming at? There will be no
coverage for that location unless you have Third Party Property Damage (aka
location insurance). This is for the very same reason as the paragraph above –
the location is in your care, custody, and control.

small book. It is for this reason that you want to explore all potential
options when contacting your broker for a Production Insurance quote. If you
don’t have a full understanding of all the caveat’s you run the risk of a major
financial loss.

Custody, and Control, as that plays a huge and often overlooked part in whether
a claim is paid.

Few people take the time to read their policies but I can’t

understand and ask your broker for an explanation. You may well find there is
additional coverage you’ll want to add – before it’s too late.

I frequently get inquiries for (Production) E & O
insurance and it seems many of those aren’t really prepared. To apply, you
first need to have retained a Clearance Attorney. Why? Because the attorney not
only sets all your clearance procedures, they are also named on the insurance
application. Because that comes with significate risk for them, it is also
common for the attorney to review the entire – completed production, including
the underlying documents, to ensure that all necessary rights have been
obtained and that there are no defamation, privacy, copyright or trademark
violations.

If you don’t have a clearance attorney, you may want to
consider Ted Gerdes (Gerdes Law in Beverly Hills, gerdeslaw.com). I’ve used him
for years and he is as thorough and diligent as they come.

Last June I began exploring the country. My two cats and I
have been living in my bus and on the road since. Currently, I’m in San Antonio,
where I’ve been since mid-December, and will be until January 29th
when I head to South Padre Island.

I work (at my desk) 6 to 8 hours per day, so it’s important
to note is that I’ve been working with you over the past 7 months from the road
with virtually no hick-up, and I’m confident that my service has remained just
as it was when in San Clemente. I will continue to travel to L.A. to see
clients, so I’ll be around.

As for security, I use my own secure internet connection –
not the RV parks – so your information is every bit as secure as it is in my
San Clemente office.

My business continues to be based there, and thanks to
Microsoft Cloud, it is business as usual for me.

If you have any concerns or feel my service has been sub-par
over the past seven months, please let me know. Service of my customers remains
my number 1 priority.

How long this last and how far I go is anyone’s guess. To
show you how slow I’ve been rolling, I’ve only been to AZ, NM, OK, and a third
of Texas. I’ve seen most cities, mountains, and important museums in each
state, and prefer to settle at each for a while, so I can learn the area, people,
and sites. I do know the next Texas stops will include South Padre Island,
Corpus Christi, Houston, Austin, Waco, and Dallas. So far, it has been an
amazing journey! I wish I could tell you all the cities I’ve been to and what
I’ve experienced thus far, but it would take an email the size of a small book.

In the now-failed ACA repeal and replace bill was a plan to
eventually allow health insurers to sell across state lines. While I support the
idea, there is one huge answer that has not been addressed: provider
agreements. Would each physician be forced to sign a provider contract with
every out of state insurer they deal with, or do these agreements go by the wayside
and
each policy contain a provision stating the maximum the will pay on any one procedure
code? Surely they won't just pay whatever the provider bills (?). If anyone knows the answer I’d love to hear it, as this is too important to
not be addressed – especially when the stated aim is to lower insurance
premiums.

25/75% co-insurance, and a max out of pocket of 5,000., and do away with mandatory
“essential” health benefits such as pediatric dental and vision (people can but
it if needed).

What the following announcement from Blue Shield means is
that you will no longer control who your primary care physician is – something that
has always been a significant benefit of a PPO plan.

Will all the others (including Anthem) follow suit? Don’t
bet against it.

We chose to get out of individual insurance when the ACA
became effective solely because of our prediction of nothing but nightmares –
and unfortunately it has been proving true.

Covered California introduces a new feature for PPO members

On August 16, 2016, Covered California sent a notification to
members introducing a new addition to PPO plans. Starting in 2017, Blue Shield
of California will match a Primary Care Physician (PCP) for all of our
on-exchange and off-exchange IFP PPO members enrolled in non-grandfathered
plans.

Although this update offers our members the ability to build a
relationship with a PCP, this does not change the way our members access care.
Members of non-grandfathered PPO plans will continue to have the freedom to
choose specialists and other providers – without referrals inside or outside
the network – as they do now.

This new feature gives our PPO members a central point of contact in the health
system for receiving long-term, comprehensive, coordinated care for most health
needs. PPO members
are able to switch PCPs at any time. There is no
action for members to take. Blue Shield will provide additional details on this
new feature in the coming weeks

Touring Performers Insurance is designed for bands,
entertainers, and performers that travel and perform shows while on the road.
This program provides a comprehensive portfolio of coverage required by such
risks. The program is flexible enough to cover any number of tours or shows
during the policy term.

Eligible entertainers include music of any category
(other than rap/hip-hop), comedians, speakers, performers and more. The program
may also be utilized for house bands, cover bands, and undiscovered bands that
require an annual policy in order to perform at small venues

Limits are available up to 10 million for liability.
Equipment can be covered for up to 5.0 million. The program is available to
risks based in the U.S. and covers the U.S. and Canada. However, risks with
foreign exposure may purchase coverage to cover that exposure as well.
Bad idea!

Lately there has been a trend amongst small producers to “buy” insurance by entering into a co-producer agreement. But they’re not buying insurance. They are buying a piece of potentially worthless paper to rent locations, equipment, and etc.

If you’re really buying insurance why isn’t your name shown as a named insured on the certificates of insurance, film permit filing, and et cetera?
Let’s look at some of the risk you take:

Your name is shown along with the co-producer on rental agreements, and once a claim is filed the carrier may only cover (at best) the portion the co-producer is responsible for – leaving you completely exposed.

Look at the insurance limits: for example, $250,000 in rented misc. equipment is the total annual limit. Do you know how much of that has been set aside for claims by others? There might be nothing left to cover your damage. Buy your own policy in your name and the limits are yours alone

God forbid you have a general or hired/non-owned auto liability claim.

This practice is actually illegal in the state of California. Why you ask? the insurance carrier doesn’t know who you are and never had a chance to underwrite the risk.

So there you have it. If you really want to be insured, spend the extra money and do it right. There may well be a time where you’re glad you did.

As they say, “nothing good is cheap and nothing cheap is good!”
