<p>One of the main purposes of the immigration system is to allow foreign nationals into the U.S. who will make a positive impact on the United States economy, society, and job market. Because of that, it should not be surprising that special preference is given to investors and entrepreneurs who wish to develop an enterprise in the U.S. Read on to learn what the E-2 visa fees are and how much you need to invest to qualify.</p>
<h2><span id="E-2_Visa_Fees_and_Application_Cost"><b>E-2 Visa Fees and Application Cost</b></span></h2>
<p>Here are the basic fees that you can expect to encounter when pursuing an E-2 visa:</p>
<ul>
<li>The basic filing fee for all I-129 petitions is <b>$460</b>. This fee must be paid each time that the petition is filed including for extensions and amendments.</li>
<li>If you are outside the U.S. and need to use consular processing, then you will need to pay a <b>$205</b> <a href="https://pollaktravelnation.com/tn-visa/" title="TN Visa" data-wpil-monitor-id="512">filing fee for your DS-160 visa application cost</a>.</li>
<li>There is an <b>$85</b> biometric services fee.</li>
<li>If your spouse or dependents are going to accompany you, an I-129 petition will need to be filed for each visa issued along with the required filing fee.</li>
<li>Some additional costs may include traveling costs to the embassy and the U.S. as well as the premium processing fee.</li>
</ul>
<p>To recap, if you are in the U.S., then your total application cost will be <b>$460</b> for each E-2 visa you need. If you are outside the U.S., then each visa will have a total application cost of <b>$750</b>.</p>
<h3><b>What About Premium Processing?</b></h3>
<p>Because the usual six-month processing time for the I-129 petition can be difficult to plan for, the USCIS has created the<a href="https://www.uscis.gov/i-907" target="_blank" rel="noopener noreferrer"> premium processing service</a>. This allows you to have your petition processed <b>within 15 calendar days</b> for an extra E-2 visa fee of $1,440.</p>
<p>However, this feature does not alter your chances of getting approved. It only speeds up the <a href="https://pollaktravelnation.com/j-1-visa/" title="J-1 Visa" data-wpil-monitor-id="524">processing time for your petition</a>. It is also important to note that even though <a href="https://pollaktravelnation.com/h-1b-visa/" title="H-1B Visa" data-wpil-monitor-id="514">premium processing has been suspended for H-1B visas</a>, it is still available for anyone petitioning for an E-2 visa.</p>
<h2><span id="How_Much_Do_I_Need_to_Invest"><b>How Much Do I Need to Invest?</b></span></h2>
<p>While your <a href="https://pollaktravelnation.com/eb-5-investment-green-card/" title="EB-5 Investment Green Card" data-wpil-monitor-id="520">investment amount is not necessarily considered an E-2 visa fee</a>, it is a cost that must be considered when preparing to petition for this visa.</p>
<p>Officially, <b>there is no minimum or maximum amount of funds that must be invested</b> in order to qualify. The USCIS does not quantify this requirement because the investment amount depends heavily on the size of the proposed enterprise.</p>
<p>The stipulation placed on the investment is that the enterprise cannot be considered “marginal”. The USCIS defines a marginal enterprise as “one that does not have the present or future capacity to generate more than enough income to provide a minimal living for the <a href="https://pollaktravelnation.com/consultation/" title="Consultation" data-wpil-monitor-id="525">treaty investor</a> and his or her family.”</p>
<p>In contrast, your investment must be considered “substantial” in order to qualify. This means that:</p>
<ul>
<li>The amount of money invested is a large portion of the total purchase cost of a pre-existing enterprise or the cost of developing a new one.</li>
<li>The amount should make it clear to the USCIS that your financial commitment is enough to promote the success of the enterprise.</li>
<li>The amount should make it clear that your enterprise is likely to succeed due to your involvement and investment.</li>
</ul>
<p>A general rule of thumb is to <b>make sure that your investment exceeds $100,000</b>. If the enterprise is larger than your investment will need to be adjusted appropriately. If the enterprise is very small, then a smaller amount may be allowable. However, because there are no concrete numbers given by the USCIS, it is important to sit down with your immigration attorney to decide if your investment amount is sufficient.</p>

<p>The<a href="https://www.immi-usa.com/e2-visa/" target="_blank" rel="noopener"> E-2 visa</a> is a nonimmigrant visa designed for foreign nationals who wish to invest significant capital into an enterprise in the U.S. These foreign nationals must be citizens of countries that hold a Treaty of Friendship, Commerce, or Navigation with the United States.</p>
<p><b>To qualify for an E-2 visa, the following requirements must be met: </b></p>
<ul>
<li>The investor—either a person, corporate entity, or partnership—must have citizenship in one of <a href="https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/fees/treaty.html" target="_blank" rel="noopener">these treaty countries.</a></li>
<li>If it is a business, at least 50% of it must be owned by persons with the treaty country’s nationality.</li>
<li>The investment, which can be in funds or assets, must be “<a href="https://www.uscis.gov/working-in-the-united-states/temporary-workers/e-2-treaty-investors" target="_blank" rel="noopener noreferrer">substantial</a>,” committed, and irrevocable.</li>
<li>The investment must be sufficient enough to guarantee the successful running of the operation.</li>
<li>The investment must generate significantly more income than just to meet your personal and family needs or it must have a significant impact in the United States economy.</li>
<li>The investment must be a real operating enterprise, an entrepreneur undertaking, or active commercial enterprise.</li>
<li>You (the investor) must have control of the funds and you must put the investment at risk in the commercial sense.</li>
<li>Your purpose in coming to the United States must be to develop and direct the enterprise.</li>
<li>If you are not the principal investor, you will be considered an essential employee, employed in an executive, supervisory, or highly specialized skill capacity. An ordinary skilled or unskilled worker does not qualify for an E-2 visa.</li>
</ul>

<p>Here are the steps if you are already currently in the U.S. under a different visa:</p>

This may take up to six months to process if you do not <a href="https://pollaktravelnation.com/f-1-student-visa/" title="F-1 Student Visa" data-wpil-monitor-id="532">opt for the premium processing service</a>. You must file this petition before your previous visa expires. Otherwise, you will be considered “out of status, which can have serious consequences.</li>
<li>If your petition is approved, then your status will automatically switch to E-2 visa status.</li>
</ul>
<h3>E-2 Visa Process Outside the United States</h3>
<p>Here are the steps if you are currently outside the U.S.</p>
<ul>
<li>You will also need to file an I-129 petition and wait for approval.</li>
<li>If the petition is approved, you will then be issued an <a href="https://pollaktravelnation.com/sibling-green-card/" title="Sibling Green Card" data-wpil-monitor-id="523">appointment date for an interview with an immigration</a> officer.</li>
<li>On that date, you will need to travel to the designated U.S. consulate or embassy in your home treaty country in order to have your biometrics taken and go through your interview. <p>Once your visa is issued, it will be valid for an initial period of five years. At the end of that period, you will have the opportunity to extend your visa indefinitely in one-year increments provided that your involvement in your enterprise is still required.</p>
<p>One of the<a href="https://www.uscis.gov/working-united-states/temporary-workers/e-2-treaty-investors" target="_blank" rel="noopener noreferrer"> main advantages of the E-2 visa</a> is that you do not need an employer or program to sponsor you and petition on your behalf. As an entrepreneur investor, you can self-petition, cutting down on the processing time. However, this means that all <a href="https://pollaktravelnation.com/b-1-visa/" title="B-1 Visa" data-wpil-monitor-id="534">processing fees are your responsibility instead of your employer’s</a>.</p>
<p>If you are the employee of a <a href="https://pollaktravelnation.com/visa-checklist/" title="Visa Checklist" data-wpil-monitor-id="535">treaty investor</a>, then you also qualify for an E-2 visa. However, you must have your investor employee file a petition on your behalf.</p>
<p>It is important to note that you must be a citizen of one of <a href="https://travel.state.gov/content/visas/en/fees/treaty.html" target="_blank" rel="noopener noreferrer">these treaty countries</a> in order to qualify. You do not need to be currently living there, but you do need to maintain valid citizenship in one of those countries.</p>
<h2><span id="When_Should_the_E-2_Visa_Investment_Be_Made"><b>When Should the E-2 Visa Investment Be Made?</b></span></h2>
<p>You can only be considered to have made your E-2 visa investment after you have put the “money at risk.” This means the investment amount has been irrevocably committed to the business enterprise. Without that, your E-2 treaty investor registration may not be granted. Keep in mind that uncommitted funds put in a bank <a href="https://pollaktravelnation.com/account/" title="Account" data-wpil-monitor-id="509">account</a> or similar financial security will not count as an investment. Also, idle or speculative investments or a paper organization does not qualify as an E-2 investment.</p>
<p>However, if you aren’t comfortable parting with your funds before the approval of your E-2 registration, you can play it safe by putting the investment funds into an escrow account. In fact, the escrow account arrangement could be your best bet if you are purchasing an existing enterprise. It is an ideal way of buying a franchise, purchasing expensive capital equipment, and leasing a commercial space for your E-2 enterprise. You would only need to work out an agreement on how the funds would be transferred to the seller after the approval of your E-2 registration.</p>
<h2><span id="How_to_Sponsor_an_E-2_Visa_Employee"><b>How to Sponsor an E-2 Visa Employee</b></span></h2>
<p>Once the principal investor has successfully <a href="https://pollaktravelnation.com/register/" title="Register" data-wpil-monitor-id="510">registered</a> as an E-2 treaty investor, they can file an E-2 visa application on behalf of their qualifying employees. An employee may qualify for an E-2 visa under one of these two categories:</p>
<h3>E-2 Specialist or Essential Skilled Workers</h3>
<p>For an employee to qualify for this category, they must be highly skilled level people. It must be demonstrated in the petition that the employee:</p>
<ul>
<li>The employee has specialized knowledge of the enterprise which may not be easily found in the United States</li>
<li>It is necessary to bring the employee to the United States for the efficient operation of the enterprise.</li>
</ul>
<h3>E-2 Managers, Executives and Supervisors</h3>
<p>Under this category, the employee must meet any of the above three descriptions. E-2 managers and executives should be those in top positions and manage an entire structure of the business or a critical part of the business. If it is a larger business, the principal investor may not even spend much time in the United States.</p>

<p>The cash value of the assets belonging to your household may be added to help you meet the requirements. The assets must, however, be worth at least three times the difference between your actual household income and the income requirement.</p>

If the total household income is $25,000, you would have a difference of $14,000 to make up. <h3>Having a Joint Sponsor</h3>
<p>Having a joint sponsor is another way of meeting the K-1 visa income requirements. <p>Now that your fiancé(e) is already in the U.S., you will be expected to get married within 90 days of his or her arrival. For your fiancé(e) to continue living in the U.S. lawfully, he or she will need to file for adjustment of status. At this point, you will need to submit another affidavit of support.</p>
<p>However, this will require another form entirely: the <a href="https://www.immi-usa.com/i-864-affidavit-of-support-immigration-form-complete-guide/" target="_blank" rel="noopener">I-864</a>. This affidavit is to show that you have the financial ability to support your alien fiancé(e) after they become a lawful permanent resident. The threshold is a little higher than that of the I-134. For the I-864, you must show that your income is at least 25% higher than the HHS poverty guideline for that year.</p>
<p>Signing the affidavit of support means you are willing to accept legal responsibility for the financial well-being of your K-1 spouse until he or she becomes a citizen or is credited with <a href="https://www.ssa.gov/OACT/COLA/QC.html" target="_blank" rel="noopener noreferrer">40 quarters of social security coverage</a>. Until either of these two conditions is met by your spouse, you will be bound by this affidavit.</p>
<p>Not even divorce can end your sponsorship obligation, as you could be called upon to repay any debt incurred by him or her for any means-tested benefits. <p>One of the requirements of the <a href="https://pollaktravelnation.com/perm-labor-certification/" rel="noopener">PERM labor certification</a> is for the employer to include experience or relevant education necessary to carry out the job. The U.S. Department of Labor takes this very seriously and puts <a href="https://www.dol.gov/agencies/eta/foreign-labor/programs/permanent" target="_blank" rel="noopener">measures in place</a> to ensure the position is not displacing a domestic worker. Sometimes, the foreign work obtains a part of all of their experience for the job while they are working for the green card sponsoring employer. How does the DOL respond to that? Keep reading to find out!</p>
<h2><strong><span id="How_the_Department_of_Labor_Views_On-the-Job_Experience">How the Department of Labor Views On-the-Job Experience</span></strong></h2>
<p>Let’s use an example to highlight this particular situation. Prateek Jamal is hired by Company X with a bachelor’s degree in computer science and four years of work experience. Three years later, Prateek now has a computer science degree and seven years of on-the-job experience. Company X acknowledges how great of an employee he is and now they raise their standards so when they go to fill his job, they now want someone with more than three years of experience. From the Department of Labor’s viewpoint, they are not interested in what the most ideal candidate looks like, only the minimum <a href="https://pollaktravelnation.com/h-1b-visa/" title="H-1B Visa" data-wpil-monitor-id="501">required experience</a> for a person to carry out the job so they would be concerned if the new requirements for Prateek’s job were now seven years of job experience plus a bachelor’s degree. When the DOL is analyzing the <a href="https://pollaktravelnation.com/r-1-visa/" title="R-1 Visa" data-wpil-monitor-id="498">green card sponsoring employer</a>, they view Prateek’s job as temporary in nature so even though he may be filling the need for Company X, the company must still test the domestic labor market to fill the position by a U.S. worker first, who meet the minimum job qualifications (not necessarily the ideal criteria, like Prateek now possesses).</p>
<p>One way companies bypass this is by promoting from within to a higher level position. Say for example, Prateek is now promoted to a higher-up position, takes on additional responsibilities and also requires the experience he has gained, then the DOL would be more willing to accept this. There is a rule, however. The green card-sponsored job must involve more than 50% different job responsibilities, meaning it must not be substantially comparable to the new position. <a href="https://pollaktravelnation.com/free-immigration-consultation/" title="Free Immigration Consultation" data-wpil-monitor-id="503">Consult with your immigration</a> attorney to ensure the job and the candidate meet the DOL requirements.</p>
<p><strong>Does this rule still apply if the green card sponsored employee leaves the company and then is later rehired? </strong></p>
<p>Yes, it still <a href="https://pollaktravelnation.com/k-3-spouse-visa/" title="K-3 Spouse Visa" data-wpil-monitor-id="504">applies if the foreign employee must still rely on work</a> experience gained with the company in order to meet the qualifications for the job.</p>
<p>So for example, Prateek was hired with his computer science degree and four years of experience but needed to return to his home <a href="https://pollaktravelnation.com/e-1-treaty-trader-visa/" title="E-1 Treaty Trader Visa" data-wpil-monitor-id="505">country after working for Company</a> X for two years (and did not gain any more experience while gone) and then is rehired by Company X and the PERM labor has the requirements as six years of experience plus a bachelors degree, the company is still responsible to prove that the position he is rehired for is not comparable to the job he worked at before leaving the country.</p>
<p><strong>What if Prateek gained more experience while he was gone from Company X?</strong></p>
<p>Let’s say after working for Company X, he gets hired by Company Z and works there for one year but they do not file a PERM labor for him. He decides to go back to work for Company X at this point and they sponsor his <a href="https://pollaktravelnation.com/family-green-card/" title="Family Green Card" data-wpil-monitor-id="500">green card</a> case. Prateek can now use that one year of <a href="https://pollaktravelnation.com/l-1-visa/" title="L-1 Visa" data-wpil-monitor-id="502">experience from Company Z to apply towards the requirements</a> of the new position with Company X. They will need to demonstrate that the new position is different from his last position but they do not need to meet the requirement of being 50% different if the new job has enough additional responsibilities. Note that the DOL will require a comparison of these different responsibilities and the experience Prateek gained in relation to other positions within the company (organizational chart). Expect the DOL to inquire about payroll records as well.</p>
<p>We often see <a href="https://pollaktravelnation.com/f1-to-green-card/" title="F1 to Green Card" data-wpil-monitor-id="506">approvals in cases</a> where the employee moves up from lower-level jobs to upper managerial positions.</p>
<h2><span id="PERM_Labor_Certification_Requirements"><strong>PERM Labor Certification Requirements</strong></span></h2>
<p>In order to qualify to begin the PERM process, the following requirements must first be met:</p>
<ul>
<li>You must have an existing <a href="https://pollaktravelnation.com/eb-3-visa-complete-lawyer-guide/" title="EB-3 Visa: Complete Lawyer Guide" data-wpil-monitor-id="499">permanent job offer by a U.S. employer</a>.</li>
<li>The offered wages are required to be equal or above the DOL prevailing wage. DOL will subject this to the specific position.</li>
<li>The local job market has been analyzed for qualified candidates. <p>In the F-3 category, China, India and all other countries of chargeability remain at July 22, 2012. Mexico remains at June 15, 2001 and Philippines remains at September 22, 2004.</p>
<p>In the F-4 category, China, and the rest of the world remain advance two months to June 1, 2008. India remains at October 1, 2006 while Mexico and Philippines remain the same.</p>

<h3>Priority Dates</h3>
<p>The first <a href="https://pollaktravelnation.com/terms/" title="Terms and Conditions" data-wpil-monitor-id="452">term</a> that you’ll hear thrown around is the priority date. Each person who files a petition with the USCIS receives a priority date when the government obtains your petition. A priority date establishes a person’s place in line to get an immigrant visa. Keep this date handy since you will need it to compare to the dates in this bulletin. Remember that your priority date does not move, and you cannot change it except under certain circumstances.</p>
<p><strong>Note:</strong> <em>Priority dates are not relevant for <a href="https://www.immi-usa.com/ir1-cr1-visa/" target="_blank" rel="noopener">immediate relatives</a> of U.S. Citizens (e.g., spouses or minor children) as that category is always current.</em></p>
<h3>Final Action Dates</h3>
<p>Final action dates are based on the green card category and the <a href="https://www.immi-usa.com/cross-chargeability-rule/" target="_blank" rel="noopener">chargeability area</a>—your country of origin. Therefore, the final action dates constantly change based on how many people from each chargeability area have petitioned for that <a href="https://pollaktravelnation.com/eb-5-investment-green-card/" title="EB-5 Investment Green Card" data-wpil-monitor-id="458">green card</a>.</p>
<p>If <a href="https://pollaktravelnation.com/k1-visa-to-marriage-green-card/" title="K1 Visa to Marriage Green Card" data-wpil-monitor-id="464">green cards</a> are still available, the final action date will likely move closer to your priority date. If <a href="https://pollaktravelnation.com/canadian-couples-journey-to-green-card-and-u-s-citizenship/" title="Canadian Couple’s Journey to Green Card and U.S. Citizenship" data-wpil-monitor-id="465">green cards</a> are unavailable, you will not see any movement from that final action date. However, if the limit has passed, you may see the date retrogress or move backward from your priority date.</p>
<p>Once the final action date in your green card preference level and chargeability area reaches your priority date, your priority date will be considered current. Once current, you will <a href="https://pollaktravelnation.com/gc-consular-processing/" title="GC Consular Processing" data-wpil-monitor-id="456">adjust your status or go through consular processing</a>.</p>
<h3>Date for Filing Charts and I-485</h3>
<p>You’ll notice there are two charts for each category.</p>
<p>The Date for Filing chart determines whether or not one can submit the final <a href="https://pollaktravelnation.com/about-us/" title="About Us" data-wpil-monitor-id="460">immigrant visa application</a>.</p>
<p>The Final Action Date chart indicates whether an immigrant visa number will be available.</p>
<p>If you need to file an adjustment of status, Form I-485, you need to follow the Final Action Date chart to know when to file based on your priority date. However, sometimes USCIS will note that they’ll accept I-485s based on the Date for Filing chart. USCIS will use this chart when more <a href="https://pollaktravelnation.com/f-1-student-visa/" title="F-1 Student Visa" data-wpil-monitor-id="466">immigrant visas are available than applicants</a>.</p>
<p>USCIS announces which chart applicants can use within a week of the visa bulletin’s release.</p>
<h2><span id="Can_You_Shorten_Your_Waiting_Time">Can You Shorten Your Waiting Time?</span></h2>
<p>The short answer is: probably not. However, there are two prominent cases in which you may be able to shorten your <a href="https://pollaktravelnation.com/marriage-green-card/" title="Marriage Green Card" data-wpil-monitor-id="453">green card processing time</a>, which we will explain here.</p>
<p>The first way is to file an <a href="https://pollaktravelnation.com/eb-1-green-card-lawyers/" title="EB-1 Green Card Lawyers" data-wpil-monitor-id="461">I-140 for a green card</a> and chargeability area with a current priority date. In this case, rather than wait the usual six months for your petition to be processed, you can pay an additional <a href="https://pollaktravelnation.com/h-1b-visa/" title="H-1B Visa" data-wpil-monitor-id="467">fee for premium processing</a>, which will shorten the processing time to 15 calendar days. However, this is only available for certain <a href="https://pollaktravelnation.com/eb-2-green-card/" title="EB-2 Green Card" data-wpil-monitor-id="462">green cards that use the I-140</a>. It is unavailable for <a href="https://pollaktravelnation.com/eb-2-niw-green-card/" title="EB-2 NIW Green Card" data-wpil-monitor-id="457">family- or investment-based immigration and the EB-1C or EB-2 NIW</a>.</p>
<p>The second situation involves <a href="https://www.immi-usa.com/eb3-eb2-porting/" target="_blank" rel="noopener noreferrer">green card “porting</a>,” or transferring your application from a lower preference level to a higher one to take advantage of the shorter waiting times. This is misleading because you don’t port your green card. In reality, you need to start with a new petition (and a new PERM if necessary). The “porting” aspect only comes in when you indicate that you want to retain your original priority date.</p>
<p>As attractive as “porting” might seem, it is a delicate process with particular requirements. Therefore, running decisions like these through your immigration attorney is always good.</p>
