52.

The legal battle over Credit Suisse’s dramatic collapse just took a sharp turn. A U.S. federal judge has ruled that investors who lost everything on the bank’s controversial Additional Tier 1 bonds—roughly CHF 16 billion worth—can move forward with discovery in their case.

 53.
This isn’t just legal housekeeping. It’s a major green light. For the first time, plaintiffs will be able to dig into internal communications, emails, and risk reports inside Credit Suisse—documents that may reveal what really happened in the months leading up to its downfall.

 54.

 55.
The Lawsuit in Focus: A Story of Omission and Spin?

 56.
Back in October 2023, Core Capital Partners Ltd., a large institutional player, filed a class action in New York. Their complaint paints a troubling picture: while things were falling apart behind the scenes at Credit Suisse, the public was being told everything was fine.

 57.
The bank, they allege, reassured investors repeatedly that customer outflows had stabilized and that liquidity wasn’t a problem. But those public statements, according to Core Capital, didn’t match reality. Instead, they say the bank was bleeding client funds, struggling to stay afloat, and failing to address deep flaws in its internal risk controls.

 58.
Then came the emergency merger with UBS in March 2023. Swiss authorities pushed the deal through over a weekend. As part of it, they triggered a clause that allowed them to write down Credit Suisse’s AT1 bonds to zero. Gone. Just like that. Core Capital says that decision was just the final blow in a long chain of misleading behavior.

 59.
Names in the complaint include some of the bank’s top brass—people like Chairman Axel Lehmann, Ulrich Körner (the CEO), and CFO Dixit Joshi.

 60.

 61.
Discovery Ordered: A Big Step with Big Stakes

 62.
July 7 arrived with a decision from Judge Colleen McMahon that tilted things in the plaintiffs’ favor—and not just slightly, either. She refused to dismiss the central claims. More importantly, she gave the go-ahead for discovery.

 63.
That’s a big deal.

 64.
Here’s what the judge laid out:

 65.

 66.
Class discovery must wrap up by August 22, 2025

 67.
Motion for class certification is due September 19

 68.
Opposition briefs must be filed by October 10

 69.
Final replies are due October 24

 70.

 71.
In plain English? The court just gave Core Capital the green light to begin building its case from the inside out. That means subpoenas. Depositions. Internal risk memos. Anything that might show Credit Suisse executives had knowledge that contradicted their public reassurances.

 72.

 73.
A Separate Track for AT1 Bondholders

 74.
There’s more. The judge also carved out a separate space for AT1 bondholders—literally.

 75.
Another case, filed earlier by investor Ali Diabat, had already moved forward and covered shareholders and some noteholders. But AT1 bondholders? They weren’t included. And when Diabat’s legal team decided not to bring their claims, Core Capital stepped up.

 76.
Judge McMahon officially confirmed it: AT1 bondholders are their own class. Core Capital is now their lead plaintiff. Their case will run in parallel—not absorbed into Diabat’s—and they’ll get their own shot at justice.

 77.
It’s a big win for investors who were previously left out in the cold.

 78.

 79.
A Global Signal to Bondholders

 80.
This case isn’t just about Credit Suisse. What happens here could ripple across Europe’s entire banking sector.

 81.
AT1 bonds, also called CoCos, have become a go-to tool for European banks. They’re meant to act as a buffer in a crisis. Higher yield, higher risk. If things go sideways, they can be converted into shares or written down completely.

 82.
But here’s the twist: while investors know the risks are baked in, this lawsuit says the problem wasn’t the product—it was the pitch.

 83.
Until now, very few investors have gone to court over AT1 bond losses. If Core Capital succeeds, that might change.

 84.
The message to banks? Just because you issue risky bonds doesn’t mean you can withhold the truth.

 85.
And for investors: even if you take on high-risk instruments, you still deserve transparency. If the truth was hidden, you have the right to fight back.

 86.

 87.
What Happens Next?

 88.
With discovery now underway, the next couple of months could get very interesting. Emails, internal reports, board communications—anything could surface. And if it turns out the bank’s leadership knew things were worse than they admitted? That could shift the whole case.

 89.
Class certification is also coming up fast. Once that’s locked in, the case officially becomes a vehicle for all AT1 bondholders to pursue collective action—not just Core Capital.

 90.
What started as a dispute over an obscure bond clause is turning into a full-on reckoning over how one of Europe’s biggest banks communicated with its investors.

 91.
Important Dates Ahead:

 92.

 93.
August 22, 2025 – Discovery wraps up

 94.
September 19, 2025 – Class certification filing due

 95.
October 10, 2025 – Opposition briefs deadline

 285.
Media representatives from Antigua and Barbuda were present during the visit and got a first-hand look at the setup and operational plans of the plant learning how the facility will function and the potential it holds for the region. The visit provided valuable insight into geothermal technology and how it can transform the Caribbean’s energy landscape.

 286.
The geothermal plant is expected to be completed by December 2025, with full production beginning in January 2026. The facility is designed to operate for 25 plus years, providing a stable and sustainable supply of clean energy.

 506.
With Jamaica’s signature, 13 of the 15 CARICOM member states have now acceded to the partnership agreement, which was introduced by Afreximbank in 2022, following the African Union’s 2008 resolution designating the African Diaspora as the sixth region of Africa.

 507.
The move, solidified through the signing of a memorandum of understanding during the 49th CARICOM Heads of Government meeting in Montego Bay, Jamaica, pushes total available funds for the region to US$3 billion, aimed at deepening trade and investment ties between Africa and the Caribbean.

 508.
Describing Jamaica’s signature to the agreement as “an incredible opportunity for even greater transformative impact,” Professor Oramah said that it strategically positions the bank to deepen its financial engagement in the region, including potential long-term capital investments to support the growth and development of SMEs in Jamaica.

 509.
Echoing the sentiment, Okechukwu Ihejirika, acting chief operating officer for Afreximbank’s Caribbean Office added:

 510.
“The initiative the bank has taken coming into the region is something that no other institution can make happen apart from Afreximbank and I am happy for the response from the governments in the CARICOM region. That shows that we are now ready to forge a greater partnership between Africa and CARICOM. This is something no other entity can do for us and we are now rising up to the challenge.”

 511.
The bank’s leadership made the remarks at an African-Caribbean side event during the CARICOM Heads of Government 49th meeting, sponsored by JN Bank (one of Jamaica’s top three commercial banks) and Afreximbank. The event was organised by NTT Global Destinations, a trailblazing African tourism and trade consultancy company.

These, he noted, include settlement in local currencies, cross-listings on regional stock exchanges, and harmonised standards to reduce non-tariff barriers.

 517.
He also underscored the critical role of the private sector, stating, “Financial institutions, including JN Bank which I must commend, will have a key role to play in these regulations, not just through funding but through innovation in fintech, small and medium-sized enterprise (SME) financing, and diaspora bonds.”

 518.
Keith Levy, JN Bank chairman also affirmed the institution’s readiness to support the efforts while hailing Jamaica’s accession, noting that the formalisation of the partnership agreement opens the door for Jamaica to connect capital with key opportunities for bilateral growth.

 519.
“The Caribbean needs a diversification of financing for important initiatives across this region including investments in infrastructure, technology and cultural assets,” he shared. “We also see the growing economic activities in Africa in areas such as science, technology, and medicine, coupled with the fact that there is a young, educated population who will purchase goods and services and visit the Caribbean as tourists. Through trade and cooperation, we can and shall achieve mutual economic growth.”

 520.
Reflecting on the origins of the JN Group, the parent company of JN Bank, which was founded in the 1800s to provide financial security to still relatively recently emancipated Africans in Jamaica, Mr Levy noted that the partnership and discussions at the side meeting are key steps towards unlocking broader economic freedoms for people of African descent.

 521.
“The Caribbean people are part of the African diaspora and as such we must take advantage of the opportunities that are available in Africa and the Caribbean. You can fight against many things but you cannot fight against the demographics of the world,” he said.

 522.
“There are similarities in the objectives of Afreximbank, JN Bank, JN Group and NTT and all this interest comes about bridging transportation and all links between African and the Caribbean. Today is one giant step for the Caribbean and Africa,” he added.

 523.
The side event of the CARICOM Heads of Government Meeting, which featured a African-Caribbean Symposium and African Village, was held at the Half Moon Hotel Conference Centre under the theme: ‘From Shared Roots to a Shared Future: Africa and the Caribbean Unite’.
