Buoyed by a recognition among the judiciary that current practices must come to terms with the proliferation of electronically stored information, and by the Department of Justice's acceptance of the principle that amending the Rule would be useful, an amendment now appears likely. But the playing field is not level — not even close. Whereas the government has virtually unlimited access to business records during a grand jury investigation, the only means by which a white-collar defendant can require the production of business records from a non-party is through a subpoena under Rule 17(c) of the Federal Rules of Criminal Procedure. The extension was announced on March 10, 2017 by Acting Assistant Attorney General Kenneth A. Blanco in a speech at the American Bar Association’s National Institute on White Collar Crime. Blanco explained that when the Pilot Program expires, the DOJ will evaluate its “utility and efficacy” to determine “whether to extend it, and what revisions, if any, we should make to it” and stated that “[t]he program will continue in full force until we reach a final decision on those issues.” [...]</p>]]></description></item><item><title><![CDATA[Morvillo Abramowitz Partner Jeremy H.
